NSW: Can parking offenders be towed from common property?

In Strata Parking, the vehicle may be moved to another less obstructive position on the common property or another lawful place off the common property. However, the car cannot legally be moved until the expiration of a period of at least five days in compliance with the removal notice.

Enforcement of by-laws is a committee issue. The difficulty is knowing who it belongs to. If it is a guest / invitee in visitor car parking – leave the car be. Adjudicators have rarely taken a liking to restrictions on the amount of a time a visitor car park can be used.

New South Wales

  • NSW Fair Trading: Parking in Strata Schemes
    Residents or their visitors are not entitled to park in other lot owners spaces, on common property or in spaces allocated to emergency vehicles. Visitors can only park in allocated visitors’ spaces for a reasonable time, or as indicated in any signage. If a lot entitlement does not include a car parking space, then the residents cannot park in the strata scheme.
  • NSW Fair Trading: Abandoned Goods and Vehicles
    Owners corporations can take steps to remove goods and vehicles that have been abandoned on common property provided they comply with relevant provisions in the Act and its Regulation.

Western Australia

    In February 2020, the Western Australian Government released a statement that wheel clamping will be prohibited as a way of controlling parking on private land.
