QLD Q: One owner wishes to alter their property but the alterations would include making structural changes to the common lot area. Does this require a resolution without dissent or is it a special resolution?
VIC Q: What are the risks, if any, in purchasing a unit predominantly because of its great courtyard if the courtyard is not on the title? Are there options to ensure exclusive use of the courtyard?
NSW Q: A unit owner installed a blind without seeking approval and has since passed away. The owner's son has inherited the lot. Is the son now responsible for arranging for approval of installation of the blind?
QLD Q: Is it acceptable for the apartments above us to hose their balconies and balustrades into our courtyard and pool? Each time this occurs it takes hours to clean all the dirt from 6 floors above.
This decision regarding an owners corporation failing to comply with an order to repair common property, confirms that NCAT does have power to penalise parties who breach orders & dovetails nicely with new strata laws that are due to commence later this year. Adrian Mueller, JS Mueller & Co Lawyers
NSW Q: One of our lot owners sometimes mows the lawn in front of their unit. If they hurt themselves while mowing and gardening on either their lot or common property, could they sue strata?
QLD Q: What happens if prior to a meeting date when one or more of the owners who originally requested that the meeting occur withdraw their support? This would mean that there is no longer 25% support?
