QLD Q: Our new building has many defects. An EGM was recently held and 13 of the 17 owners voted to take the case to QCAT for mediation, but the developer who owns 6 units was able to vote the special resolution down. What do we do now?
NSW Q: We have found after 7 years a balcony overhead structure was built poorly and is failing. Should I be able to ask the insurer if the defect is covered by building insurance?
WA Q: If a Motion at AGM is passed by majority owners, is this resolution binding on all owners and is the Strata Company obligated to follow such resolution?
NSW Q: Our elder neighbours below complained about our footstep noises on our hard floors. We have been served a breach notice and instructed to fix the issue. No expert reports have been obtained. Do we need to comply?
QLD Q: Some committee members wish to improve the scheme to 4 star resort standard. There is only $60,000 in our sinking fund. Are these actions considered unreasonable?
WA Q: Our apartment building shares expenses with the attached hotel. We would like to look into the splitting of the accounts, but our strata manager will not allow us to involve a third party to check the financial records. Is this correct?
NSW Q: Water has entered the external wall of our building and has damaged a section of the floating floor of a lot owners apartment. Is the repair the responsibility to be compensated by the buildings insurance?
QLD Q: Members of the Committee have access to the CCTV on their phones. Is this legal? There is no control of what other parties may be shown footage. E.G. pool areas etc.

Public consultation opens on WA’s newest form of land tenure
On the 6 Nov, Lands Minister Ben Wyatt released the draft Community Titles Regulations 2020 for public comment, moving Western Australia closer to the expected introduction of community schemes next year. Information and resources on community titles, including the draft regulations, are available through http://www.strata.wa.gov.au.
Feedback on the draft community titles regulations is being sought over the next month until December 9
