Where to go when you need help with Strata in WA

This article about where to go for help with your WA strata questions has been provided by Strata Community Association (WA).

Trying to find answers to your burning strata questions can be challenging, particularly when it relates to the Strata Titles Act.

As the Strata Titles Act is a piece of legislation, answers to questions you may have on this might be considered legal advice, which is why it can be challenging to get an answer even when it seems like a simple question.

To know where to reach out for help, it’s important to understand the different bodies involved in strata.

Landgate

Landgate operates as a statutory authority and is accountable to the Minister for Lands. Landgate administers the Strata Titles Act and has a useful guide on interpreting this Act.

When to contact Landgate

Landgate has a phone, webchat, and email channels where customers can access guidance in relation to strata documentation. Landgate can also provide information to assist strata participants in understanding their rights, responsibilities, and obligations, as well as strata scheme restrictions.

State Administrative Tribunal (SAT)

SAT has jurisdiction over strata title disputes and can make orders to settle strata disputes. SAT is the go-to place for strata disputes, with the exception of recovering unpaid levies, which remains with the courts.

When to contact SAT

SAT is not able to provide advice on strata title matters. SAT is a decision making body and only deals with applications made under the Strata Titles Act.

Strata Community Association (WA) (SCA (WA))

Strata Community Association (WA) is the peak industry body for strata management in Western Australia. All strata managers, support staff, and strata service suppliers can become an SCA (WA) member.

When to contact SCA (WA)

SCA (WA) is not able to provide advice on strata title matters. SCA (WA) has instead created an owner subscription, where owners can stay up to date with the latest strata news, fact sheets, and education available.

SCA (WA) offers low-cost, introductory training for owners covering the basics of strata and some of the most frequently asked questions. These sessions range from Committee Training to Owner Financials. To stay up to date with the latest events and information, become an SCA (WA) subscriber!

Consumer Protection

If a strata manager is also a real estate option, the strata company has the option to approach Consumer Protection for assistance.

    Our strata Company will be receiving a large lump sum over half a million , does this mony have to stay in the strata company or can it be disbursed with the owners in the strata company, we currently have nearly $100,000 in the kitty so to speak for ongoing work, so the money coming in is not really needed for any work currently..

    Hello
    we live in 19B [removed by admin] on Strata title together with 19A [removed by admin],
    sewerage blockage occurred in 19A pipes running through our property,
    19B had no blockage, the pipes joined after the blockage.
    The blockage was caused by tree roots on 19B property in the pipes serving 19A.
    Who is responsible to pay plumbing bill?

    What conditions should be present for a Strata Manager to increase the quarterly amount. Is the AGM the appropriate venue to discuss this increase.
    Does the decision need a 100% agreeance
    amongst the C.O.Os ( Community of Co Owners).
    From March 2014 ($400 / quarter) 2022 ($609 / quater) without any visual changes to the property.
    Please advise…

    As part of sale contract conditions of an unit we bought off the plan in Perth, the seller (property developer) committed to pay the strata levy for a term of 4 years. We are notified by the strata manager that the seller hasn’t paid any levies for 3 years. Amount due is around $ 5000 plus 600$ on interest. Is there any body that can advice how to proceed on this? Can we get the interest waves if this was not our fault. Thank you
